Jakes Auto Detailing Co. Business Policy

This policy governs the terms and conditions under which DBA JAKE CATALDO (hereinafter referred to as “Jakes Auto Detailing”) provides vehicle detailing services. By scheduling or accepting services, you, the customer, acknowledge and agree to the following terms:

1. Services and Pricing

  • Pricing Transparency: Our pricing is variable and depends on factors such as vehicle size, service type, condition of the vehicle, and other special considerations.

  • Price Changes: Prices are subject to change, but no price will change without prior notification to the customer.

  • Detailed Quotes: A detailed quote will be provided to the customer prior to the commencement of the service.

  • Compliance with Massachusetts Consumer Protection Law: In accordance with the Massachusetts Consumer Protection Act (M.G.L. Chapter 93A), our pricing and any changes to it will be communicated in a transparent and timely manner to ensure fairness and prevent deceptive practices.

2. Cancellation Policy

  • Cancellations: All cancellations must be made at least 48 hours before the scheduled appointment. Failure to provide sufficient notice will result in a $50 cancellation fee.

  • Refunds: Refunds will be issued for uncompleted services, excluding any completed services. Refunds will not be issued for services that have already been performed. However, in the event of a dispute about the service, customers are entitled to a fair hearing and resolution under the Massachusetts Consumer Protection Act (M.G.L. Chapter 93A) if the service was misrepresented or not performed as agreed.

  • Adjustments: If you are dissatisfied with the outcome of the service, we are happy to make necessary adjustments or corrections to ensure your satisfaction. This must be brought to our attention immediately following the service.

  • Emergency Exceptions: Exceptions to this cancellation policy may be made at our discretion in cases of emergency or unavoidable circumstances.

3. Legal Limitations and Customer Responsibilities

  • Car Seats: We are legally prohibited from removing or installing car seats in vehicles due to safety regulations under the Massachusetts Child Passenger Safety Law (M.G.L. Chapter 90, Section 7A). This includes any alteration of car seat installation or any other safety-related vehicle components.

  • Personal Items: It is the customer's responsibility to clear out their vehicle before the scheduled service. We are not responsible for any missing, broken, or damaged items left in the vehicle during the detailing process.

  • Responsibility for Items: In compliance with the Massachusetts Consumer Protection Act (M.G.L. Chapter 93A), we will take reasonable steps to ensure that no personal property is damaged or lost. However, customers are advised to remove any valuables prior to service.

  • Pickup/Drop-off: Our service does not include vehicle pickup or drop-off. Customers are responsible for delivering their vehicles to the designated location for detailing services.

4. Liability and Damage Policy

  • Liability Limitations: While we take every care in providing quality detailing services, the Company is not liable for any pre-existing damages or issues that may arise during the detailing process. This includes any issues caused by the vehicle’s condition prior to the service.

  • Damage During Service: In the rare event that any damage occurs to the vehicle during the detailing process, we will take immediate responsibility and work with the customer to resolve the issue. We will assess the situation and, if necessary, offer to repair or replace the damaged item, subject to the severity and cause of the damage.

  • Compliance with Massachusetts Consumer Protection Law: In accordance with the Massachusetts Consumer Protection Act (M.G.L. Chapter 93A), if damage occurs due to our negligence or failure to meet the terms agreed upon, the company will be responsible for rectifying the situation.

5. Payment Terms

  • Payment Due at Completion: Payment for services is due at the time of completion of the service unless otherwise agreed upon in advance.

  • Accepted Payment Methods: Accepted methods of payment include Cash, Check, Credit/Debit.

  • Sales Tax: Card transactions will receive a 6.5% Massachusetts Sales Tax in accordance with the Massachusetts Department of Revenue (DOR) guidelines.

  • Deposits: Deposits may be required for certain high-value services or large vehicle fleets. These will be communicated and agreed upon in advance.

  • Transparency in Pricing: All pricing, including any deposits and tax, will be clearly communicated before payment, as required by the Massachusetts Consumer Protection Act.

6. Confidentiality and Privacy

We respect your privacy and will not share or disclose any personal information obtained during the course of our business with any third parties, except as required by law.

  • Data Protection Compliance: We will adhere to the Massachusetts Data Security Regulations (201 CMR 17.00), ensuring the protection of your personal data in our possession.

7. Indemnification

By utilizing our services, you agree to indemnify and hold harmless the Company, its officers, employees, agents, and affiliates from any and all claims, liabilities, damages, or expenses arising from the use of our services, except for those directly resulting from our negligence or willful misconduct.

  • Compliance with Massachusetts Law: This indemnification clause is in compliance with the Massachusetts Consumer Protection Act (M.G.L. Chapter 93A), which protects consumers from unfair or deceptive business practices.

8. Modification of Terms

The Company reserves the right to update or modify this policy at any time. Customers will be notified of any changes, and continued use of our services will constitute acceptance of those changes.
